Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of ThrivioMeet (the “Service”), operated by ThrivioHealth Pty Ltd(“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

2. The Service

ThrivioMeet is an embeddable telehealth video platform that lets clinicians run ad-hoc video meetings and persistent clinical rooms with a waiting area. The Service is currently offered as an invite-only beta and may change, be limited, or be withdrawn at any time.

3. Accounts and eligibility

Accounts are for clinicians and clinic organisations and are created by invitation. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.

4. Guests and patients

Patients and other guests join meetings by link, identified by a display name only, and do not hold accounts with us. The clinician or organisation hosting a meeting is responsible for inviting the right participants and for the conduct of the consultation.

5. Clinical responsibility

The Service is a communications tool. It is not a medical provider and does not provide clinical advice. Clinicians and organisations remain solely responsible for the care they deliver, for clinical record-keeping, for obtaining informed consent, and for meeting their professional, registration, and legal obligations.

6. Acceptable use

You agree not to:

  • use the Service unlawfully or to harm, harass, or deceive others;
  • attempt to disrupt, reverse engineer, or gain unauthorised access to the Service;
  • record or share any session except as permitted by these Terms and applicable law.

7. Recordings

Where recording is enabled, it starts only after the participants in the meeting have consented. The hosting organisation controls whether recording is available and is responsible for the lawful use, storage, and disclosure of any recording.

8. Fees

The beta is currently provided at no charge. We will give reasonable notice before introducing fees, and any paid plans will be governed by the pricing terms presented at that time.

9. Intellectual property

We retain all rights in the Service, including its software, design, and branding. You retain all rights in the content and recordings you create using the Service.

10. Availability, warranties, and liability

The Service is provided “as is” during beta, without warranty as to availability or fitness for a particular purpose, to the extent permitted by law. Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded (including under the Australian Consumer Law). To the extent permitted by law, our liability arising from the Service is limited as set out in the final, legally reviewed version of these Terms.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction.
